This Act introduces measures so as to prevent the practice of adulteration in the sale of food and drugs. The Act, among other things, defines various offences of adulteration of food, also in relation with the preparation and labelling of food. Special provision is made with respect to the importation and sale of milk products. The Act provides for sampling and analysis of products and prosecution of offences.

These Regulations contain rules relative to hygienic aspects of food businesses. “Food business” is defined in regulation 3 as “any trade or business for the purposes of which any person engages in handling of food..”. It does not include any agricultural activity or in general wholesale trade of vegetables, handling of food at slaughterhouses, or at premises which are not used for the storage of “open” food.

This Act makes provision for various matters relating to protection of interests of consumer such as the prohibition of unfair trading practices and unfair contract terms, product liability, consumer safety, industry codes and control and administration by the Fair Trading Commission.

New rules relative to requirements for the condemnation of food are inserted in the principal Regulations. All food imported into Barbados may be inspected by a Public Health Inspector. If food is condemned the Inspector shall issue a Certificate of Condemnation Food in the form as set out in the (new) Schedule. Food unfit for human consumption shall be detained and analysed by the Government Analyst.
